This is not a simple question: the differences in distance, law, culture, and procedures that are unfamiliar to Israelis make the situation difficult and sometimes lead creditors to give up on collecting their debt.<\/p>\n First of all – if there is a reasonable fear that the debtor will flee abroad, it is advisable to apply to court for a stay of exit order<\/a>.<\/p>\n However, even if the debtor has already fled abroad, you can still check the possibility of locating them in the country to which they have fled and collecting the debt there, or realizing the debtor\u2019s assets, such as real estate, in place of the debt. It will not necessarily be possible to collect the debt fully and through the regular formal procedure, but it may be possible to take various effective actions in the matter.<\/p>\n A major problem in collecting international debts is finding a lawyer in the foreign country who specializes in writ of execution and who is familiar with the various details and laws in the area, so that they can be trusted to do a good job. Another problem is finding a debt collection company in a foreign country.<\/p>\n In addition, the costs of professional legal services abroad are very high, and not everyone can afford them.<\/p>\n Not being familiar with the foreign country’s legal system may also complicate things. Finally, relations between Israel and the foreign country in which the debtor resides affect the possibility of collecting the debt.<\/p>\n When the debtor is abroad, the creditor may try to persuade them to return to Israel and may ask the court to impose sanctions on them until they repay the debt, such as foreclosure<\/a>, restriction of a driver’s license, etc. However, when the debtor cannot be returned to Israel, action must be taken to locate them. It is advisable to consult with a lawyer who specializes in debt collection in order to check how to go about doing this and what the chances are of success.<\/p>\n Debt collection through enforcement of an Israeli judgment abroad requires knowledge of the law in the foreign country in which the judgment is to be enforced. Each country has its own legal system, but the principles of law are similar. Therefore, you may apply to court in the foreign country and request the court to recognize the Israeli judgment. Each state has its own collection system, and the local court of the foreign country will be able to order the local authorities to enforce the judgment and settle the debt.<\/p>\n An example of a country with which Israel does not have an agreement on the enforcement of foreign judgments is Britain. When an Israeli creditor wants the courts in Britain to recognize and enforce a judgment that was given in Israel, the creditor is faced with a problem, since there is no bilateral agreement on this issue between Israel and Britain.<\/p>\n To enforce an Israeli judgment in Britain, the creditor will have to prove to the British court that the judgment was decreed by an Israeli court that has local jurisdiction to do so, in accordance with the British jurisdiction laws, which derive from the rules of international private law.<\/p>\n As stated above, the general principles are similar in the various systems, so by reviewing the law in Israel it is possible to understand the general attitude of other countries to the enforcement of foreign judgments, as well.<\/p>\n The Israeli law on this matter is set forth in the Foreign Judgments Enforcement Law, 1958<\/a>. Section 3 provides that a court in Israel may declare a foreign judgment to be enforceable<\/a> if it meets the following conditions:<\/p>\n The conditions in other countries are similar, but not necessarily identical. It is therefore important to consult with a lawyer who has knowledge of private international law to understand the conditions in the country where the debt is to be collected.<\/p>\n Collecting a debt from a debtor who is abroad is not a simple task, but it is possible. First, check whether it is possible to bring the debtor back to Israel. If this is not possible, check whether the debt may be settled abroad.
